What we check in your purchase agreement
- Conditions that let you withdraw (ontbindende voorwaarden): financing, the building survey and sometimes NHG, with their deadlines. And whether one you'd expect is missing.
- The deposit or bank guarantee: how much, and by which date.
- The penalty if you don't complete the purchase, usually 10% of the price.
- The transfer date and what happens if it moves.
- Clauses that shift risk to you, such as an age, asbestos or non-occupancy clause, and the list of items that stay.
- Whether the agreement is registered with the Kadaster, so you are protected until the transfer.
- For a house: leasehold (erfpacht), easements and chain clauses that come with the property.
- For an apartment: the VvE articles, such as who pays for decisions taken before the transfer.

Questions
What's the difference between the koopakte and the leveringsakte?
The koopakte (purchase agreement) is the deal between you and the seller, with the price, the conditions and the deadlines. The leveringsakte (deed of transfer) is signed later at the notary and makes you the owner. The koopakte is where terms are agreed; the deed follows from it.
Does the check work for a house too?
Yes. The purchase agreement for a house is largely the same as for an apartment: the same conditions, deposit, penalty and deadlines. For a house we look at leasehold, easements and chain clauses instead of the VvE.
Can you check the draft before I sign?
Yes, and that's the best moment. Ask the estate agent for the draft and upload it, so you can discuss changes before signing.
I've already signed. Is a check still useful?
Yes, especially during the three-day cooling-off period, when you can still withdraw at no cost. After that, the check still shows which conditions you have and until when you can invoke them.
I'm buying an apartment. Do you also look at the VvE?
In this check we read what the purchase agreement says about the VvE. The VvE documents themselves (deed of division, minutes, maintenance plan, accounts) can be scanned for free at apartmentcheck.nl.
